WHAT INFORMATION DOES OVERTIME COLLECT?
During your journey with Overtime we collect various types of personal information about you so that we can provide our Services and so you have an enjoyable experience. Personal information is any information that may identify you as an individual or relate to you as an identifiable individual. We collect personal information about you when you use our Services, when you engage with our third-party business partners and service providers, such as our advertising service providers, or when you engage with us through social media platforms. We also collect information from you automatically through a variety of technologies, such as cookies, pixels, application program interfaces, and Web beacons, including when you use our Services, or use our applications on third-party sites or platforms. Let us tell you a little more about how this is done.
Information You Provide To Us
At Overtime, we strive to collect only the personal information that we need. The information that we collect depends upon how you interact with Overtime, such as purchasing merchandise through our online e-commerce platform, participating in our contests, connecting to our Services or contacting us through social media. Some of the information we collect may include:
Billing or shipping address
Social media handle or account
Payment card information
Age or birthday
Other information you provide to us. This may include information you provide as part of a contest or similar service
Information you provide in public forums, such as your public posts
Information you provide in direct messages, such as through social media

We may also use other technologies that are similar to cookies. These technologies may include:
Web beacons (small electronic files that let us know things, such as how many people visit a particular page on our website)
Mobile SDKs (the mobile app version of a web beacon)

Do Not Track Policy
Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time.
HOW DO WE USE YOUR PERSONAL INFORMATION (LEGAL BASIS)?
Overtime uses personal information to provide our Services to you (including to improve and personalize our Services), to process your transactions, to communicate with you, for security and fraud prevention, and to comply with various laws and regulations. Overtime uses your personal information only when we have a valid legal basis to do so. The following shows you the legal basis for the various ways in which we process your personal information:
Contractual necessity means that we need to process your personal information in order to provide you with Services you have requested. Personal information we process under the legal basis of contractual necessity include:
Contact data (e.g., name, address, email, phone number, clothing size, shoe size)
Profile data (e.g., age, birthday)
Account data (e.g., phone number)
Device data (e.g., device ID)
Legitimate Business Interest
Sometimes we process your personal information to further the legitimate business interests of Overtime or a third-party. Legitimate business interests means that processing your personal information is an important part of Overtime operating its business and providing Services to you. Examples of these legitimate business interests include:
Operation and improvement of our business, products, and services
Marketing of our products and services
Provision of customer support
Protection from fraud or security threats
Compliance with legal obligations
Completion of corporate transactions
Personal information that we process under the legal basis of legitimate business interests includes:
Contact data (e.g., name, address, email, phone number, clothing size, shoe size, personal and/or company social media accounts)
Profile data (e.g., school, clothing size)
Account data (e.g. phone number)

In some cases, we process your personal information only after you have given us consent to do so, such as when we conduct certain marketing activities. You are always free not to provide consent, or to withdraw your consent at any time after it has been given.
Other Processing Grounds
From time to time, although it is very rare, we may also need to process your personal information to comply with a legal obligation, if it is necessary to protect the vital interests of you or other individuals, or if it is necessary for a task carried out in the public interest.
WILL OVERTIME SHARE PERSONAL INFORMATION?
We may share your personal information with third-parties that help us provide Services and do business. These third-parties include:
Advertisers: We may allow advertisers and/or merchant partners (“Advertisers”) to choose the demographic information of users who will see their advertisements and/or promotional offers. You agree that we may provide any of the information we have collected from you in non-personally identifiable form to an Advertiser, in order for that Advertiser to select the appropriate audience for those advertisements and/or offers. For example, we might use the fact you are located in San Francisco to show you ads or offers for San Francisco businesses, but we will not tell such businesses who you are. Or, we might allow Advertisers to display their ads to users with similar usage patterns to yours, but we will not disclose usage information to Advertisers except in aggregate form, and not in a manner that would identify you personally. Note that if an advertiser asks us to show an ad to a certain audience or audience segment and you respond to that ad, the advertiser may conclude that you fit the description of the audience they were trying to reach.
We may deliver a file to you through the Services (known as a “web beacon”) from an ad network. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Because your web browser must request these advertisements and web beacons from the ad network’s servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site. You may be able to opt-out of web beacon tracking conducted by third-parties through our Services by adjusting the Do Not Track settings on your browser. Please note that we don’t control whether or how these third parties comply with Do Not Track requests.
Affiliated Businesses: In certain situations, businesses or third-party websites we are affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your personal information with that affiliated business only to the extent that it is related to such transaction or Service. We have no control over the policies and practices of third-party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.
Service Providers: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or Services to you: for example, we use Shopify to host our store and to receive and process your credit card transactions for us, and SuperPhone™ to collect and maintain contact information. A complete list of sub-processors with whom we share personal information to assist us in providing the Services is available here. Unless we tell you differently, our service providers do not have any right to use the personal information we share with them beyond what is necessary to assist us.
Business Transfers: We may choose to buy or sell assets, and may share and/or transfer customer personal information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information could be one of the assets transferred or acquired as part of this process.
DOES OVERTIME SECURE PERSONAL INFORMATION?
At Overtime, we use administrative, technical, and physical safeguards to protect your personal information, taking into account the nature of the personal information, the processing, and the threats posed. We are always working to improve these safeguards to help keep your personal information secure. Unfortunately, despite our best efforts, no security measures are perfect and we cannot guaranty complete security.
YOUR CONTROLS AND CHOICES
Overtime provides you the ability to exercise certain controls and choices regarding your personal information. These choices may differ depending upon where you live, such as if you live in the European Economic Area. YOUR RIGHTS IF YOU ARE IN THE EUROPEAN ECONOMIC AREA
If you are in the European Economic Area, which includes the European Union ("EU"), United Kingdom, Lichtenstein, Norway, and Iceland, you have additional rights under the General Data Protection Regulation (the "GDPR") with respect to your personal information. Under the GDPR you have the following rights:
Access: You can request more information about the personal information we hold about you and request a copy of such personal information.
Rectification: If you believe that any personal information we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data.
Erasure: You can request that we erase some or all of your personal information from our systems.
Withdrawal of Consent: If we are processing your personal information based on your consent (as indicated at the time of collection of your information), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your personal information, if such use or disclosure is necessary to enable you to utilize some or all of our Services.
Portability: You can ask for a copy of your personal information. You can also request that we transmit the information to another company where technically feasible.
Objection: You can contact us to let us know that you object to the further use or disclosure of your personal information for certain purposes, such as for direct marketing purposes.
Restriction of Processing: You can ask us to restrict further processing of your personal information.
Right to File Complaint: You have the right to lodge a complaint about Overtime’s practices with respect to your personal information with the supervisory authority of your country or EU Member State. TRANSFER OF PERSONAL INFORMATION
USE OF OVERTIME SERVICES BY MINORS
We do not wish to collect personal information from children under the age of thirteen (13). If you are under the age of thirteen (13) you should not use our Services, and should not send us your personal information. If you have reason to believe we have collected personal information of a person under the age of thirteen (13), please contact us so we may delete that information.
CALIFORNIA RESIDENTS' RIGHTS
